(ORAL) Counsel for the petitioners argues that the service which the petitioners have rendered in the cadre of Supervisors in Adult Education Scheme has already been counted as a qualifying service for the grant of pension, but the said service has been excluded while computing the leave encashment, which benefit is also a pensionary benefit and hence, the respondents are liable to be directed to grant the benefit of the service which the petitioners rendered as Supervisors in Adult Education Scheme while computing the leave encashment also.

Counsel for the petitioners further states that for the relief which has been sought in the present writ petition, petitioners have served the respondents with a demand notice on 01.03.2019 (Annexure P-5), which is still pending consideration with the respondents and the NARESH KUMAR 2019.05.13 12:26 I attest to the accuracy and integrity of this document Chandigarh

CWP-12099-2019 -2petitioners will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said demand notice. In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioners, the respondents are directed to decide the demand notice dated 01.03.2019 (Annexure P-5) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. Present writ petition stands disposed of.
