This petition has been filed for grant of regular bail pending trial in a criminal case arising from FIR No. 251 dated 14.07.2018, registered under Section 379-B & 34 IPC (Section 395, 473, 148 & 149 IPC were added lateron) and Section 25 of the Arms Act, 1959, at Police Sahnewal, District Ludhiana.

As per the case of the prosecution, five accused with muffled faces entered the shop of the first informant. The occupant of the shop was tied after putting down the shutter and the assailants took away the gold containing ear rings weighing 4 grams, some silver ornaments and one mobile phone. The petitioner is in custody since 30.07.2018 i.e. for a period of more than two years. The prosecution is yet to start recording its evidence.

Criminal Misc. No. M- 20397 of 2020 Ms. Samina Dhir, Deputy Advocate General, Punjab, has submitted that the petitioner does not have criminal antecedents. The co-accused with the petitioner, namely Sahil Kumar alias Papla was also granted the concession of regular bail vide order dated 30.08.2020.

Keeping in view the aforesaid facts and without expressing any opinion on merits of the case, it is considered appropriate to direct the petitioner to be released on regular bail as the conclusion of the trial is likely to take time. Hence, the present petition is allowed and the petitioner is ordered to be released on regular bail subject to his furnishing bail/surety bonds to the satisfaction of the learned Area Judicial Magistrate/Chief Judicial Magistrate/Duty Magistrate.
