By filing present civil writ petitioner under Articles 226/227 of the Constitution of India, petitioner seeks issuance of a writ in the nature of mandamus to consider his case for joining and allotting a school in view of the order dated 03.01.2020 (Annexure P-7) issued by respondent No.2. Perusal of the said order goes on to show that petitioner was allowed to join Govt. Middle School, Lahoriwala (6336), District Yamuna Nagar against vacant post as a Guest Teacher on the condition that he will not be entitled to back wages/seniority.

The grouse of the petitioner is that respondent No.3 vide communication dated 30.06.2020 (Annexure P-8) observed that petitioner SACHIN MEHTA 2021.07.02 17:18 I attest to the accuracy and authenticity of this document High Court, Chandigarh

CWP-11575-2021 -2could not join because of the closure of Govt. Middle School, Lohariwala. Request had also been made by respondent No.3 on 08.01.2020 to adjust the petitioner against vacant post in another Govt. Middle School, Kutipur, Yamunanagar, which would be clear from letter dated 30.06.2020 (Annexure P-8) but the petitioner has not been adjusted despite elapse of five months.

Without commenting on the merits of the case and the entitlement of the petitioner as such, the present petition is disposed off with direction to respondent No.2 to decide the representation (Annexure P-10) of the petitioner and the request made by respondent No.3 on 30.06.2020 (Annexure P-8) within a period of two months from the receipt of certified copy of this order.
