*** The case has been taken up through Video Conferencing. Learned counsel for the petitioner states that petitioner has since surrendered in the trial Court and has been released on interim bail. Application with annexures including copy of order dated 14.8.2020 passed by Judge, Special Court, Patiala has been filed, which be taken on record. I have heard learned counsel for the petitioner and learned State counsel besides going through the record.

Petitioner-accused Ravi Kaushal @ Monu had been facing trial while on bail by Judge, Special Court, Patiala. He had absented from the Court on 7.2.2020, resultantly his bail bonds were cancelled and forfeited to the State and the accused was ordered to be summoned through non-bailable warrants of arrest. Apprehending his arrest, he had approached this Court for grant of pre-arrest bail. Under the orders passed by this Court, he has put in appearance in the trial Court and has been released on interim bail. Since presence of the petitioner-accused had been procured, therefore, the petition PARVINDER SINGH 2020.11.16 15:41 I attest to the accuracy and integrity of this document Chandigarh

is accepted. The interim bail granted to the petitiioner vide order dated 10.8.2020 is made absolute subject to the following conditions :- (i) He shall appear in the Court on each and every date of hearing.

(ii) He shall not give any threat or intimidation to the prosecution witnesses.

(iii) He shall not leave India without prior permission of the Court.

(iv) He shall surrender his Passport before the Investigating Officer and if he is not having Passport then shall file the affidavit in that regard. In case the petitioner violates any term and condition on which the bail has been granted to him, the prosecution would be entitled to apply for cancellation of bail.

It is made clear that the trial Court shall be at liberty to initiate proceedings under Section 446 Cr.P.C. against the petitioner and his earlier surety and impose penalty deemed proper for causing the delay in the trial by absence of the petitioner from the proceedings without any intimation. Copy of this order be sent to the Court concerned through District and Sessions Judge, Patiala.

The petition stands allowed accordingly.
