M.M.S. BEDI, J (ORAL) Petitioner happens to be the owner of the truck which was allegedly used by the accused to carry 200 kgs. of poppy husk. He was not arrested from the spot as such, his culpability will be a debatable issue during trial.
It has been informed by the State counsel, on the instructions of ASI Kashmir Singh, that the petitioner has already joined investigation. It does not appear to be a case of custodial interrogation.
The petition is allowed. It is ordered that in the event of arrest, the petitioner will be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of the arresting officer subject to all the conditions under Section 438 (2) Cr.P.C. (M.M.S. BEDI) February 23, 2015.
