H. S. Madaan, J. (Oral) The grouse of the petitioner is that some of the persons named by her in the FIR have not been challaned. This aspect can be taken care of, since the complainant can move an application under Section 319 Cr.P.C. during the trial for summoning of such persons as additional accused.

The second grouse of the petitioner is that some of the persons, who had seen the occurrence have not been cited as prosecution witnesses by the Investigating Agency. In that regard complainant can move an application under Section 311 Cr.P.C. As far as the third contention seeking protection from the private respondents, a written representation in that regard ( Annexure P-5 ), is there on the record. In respect of that Superintendent of Police, Fatehabad, is directed to look into the grievances of the BANITA CHUGH 2018.09.20 17:59 I am the author of this document

CRM-M No. 41521 of 2018 -2petitioner as contained in representation Annexure P-5 and if he comes to the conclusion that the facts and circumstances of the case warrant taking of any action in the matter, then the needful be done as per law, within two months from the date of receipt of a copy of this order in his office.
