**** ANOOP CHITKARA, J. (ORAL) Learned State counsel submits that after receipt of Forensic Science Laboratory report, the offence is being converted from NDPS Act to Excise Act. Given above, the present petition has been rendered infructuous. However, it is clarified that the moment police department adds provisions of Excise Act, before arresting, a seven days notice shall be given to the petitioner to enable him to avail the legal remedies including under Section 438 of Cr.P.C.
