This petition has been filed under Section 528 B.N.S.S. read with Section 482 Cr.P.C. for quashing of order dated 30.10.2024 (Annexure P-5) passed by the learned JMIC, Sunam in case No. CHI/86/2019 arising out of FIR No. 88 dated 17.06.2018, P.S. Dirba, District Sangrur, titled "State vs. Balvir Singh and Others", whereby the petitioner has been declared as a 'Proclaimed Person' with a further prayer for quashing of Order dated 29.04.2024 (Annexure P-1) passed in the aforesaid case, whereby the bail/surety bonds of the petitioner have been cancelled and forfeited to the State.It is further prayed that the operation of the aforesaid orders dated 30.10.2024 and 29.04.2024 be stayed during the pendency of the present petition.

Learned counsel for the petitioner submits that the petitioner could not appear before the Courts below on 29.04.2024 as he went to abroad. As such the learned trial Court cancelled the bail orders of the petitioner and his RENU RAWAT 2026.04.09 18.46 I attest to the accuracy and integrity of this document Chandigarh

CRM-M-19077-2026 bail bonds and surety bonds stand cancelled and were ordered to be forfeited to the State and the petitioner was ordered to be summoned through non-bailable warrants of arrest. Despite non bailable warrants, petitioner did not appear and proceedings under Section 82 Cr.P.C were conducted against the petitioner and vide order dated 30.10.2024 petitioner was declared as proclaimed person. He further prays that the petitioner is ready and willing to join the proceedings before the Court and the impugned orders dated 30.10.2024 and 29.04.2024 be set aside.

On the asking of the Court, Mr. P.S.Pandher, Asst. A.G.Punjab accepts notice on behalf of the respondent-State. 5.

I have heard learned counsel for the parties and gone through the case file.

In view of the limited prayer made by the petitioner, this Court does not find any legitimate ground to interfere in the impugned order dated 30.10.2024 and 29.04.2024 passed by learned JMIC, Sunam. However, in case the petitioner surrenders before the trial Court within a period of 07 days from today at 10:00 A.M and moves an application for grant of regular bail, the trial Court is directed to consider and decide the same within a period of three days. 7.
