(Oral) The learned counsel representing respondent No.2 has informed that his client has deposited the remaining amount of `5 lakhs in an FDR in favour of his daughter and that respondent No.2 undertakes not to make any effort to encash the same and that the said amount for all the intents and purposes is to be used by his daughter.

The aforestated position regarding deposit of the balance amount of `5 lakhs is confirmed by learned counsel for the petitioner and who has submitted that in view of the aforestated position he does wish to press upon the present petition seeking cancellation of bail and that he may be permitted to withdraw the present petition. In view of the aforestated facts wherein the amount stands deposited and learned counsel for the petitioner has submitted that he does not press upon his petition for cancellation of bail, the present petition is dismissed as withdrawn.
