The petitioner through the instant petition under Section 482 Cr.P.C. is seeking fair and impartial investigation in FIR No. 157 dated 21.12.2021, under Sections 498-A and 406 IPC, registered at Police Station Women, District Police Commissionerate Ludhiana. 2.

Learned counsel for the petitioner inter alia contends that despite registration of FIR in December' 2021, the investigating agency has not filed challan against the accused. He further submits that it is a case of death still investigating officer has registered FIR under Sections 406, 498-A IPC though case of 304-B IPC is made out against the accused.

Mr. Shiva Khurmi, AAG, Punjab, who on advance notice is present in Court, on instructions from SI Davinder Pal Singh, submits that police has almost completed investigation and shortly PARAMJIT KAUR SAINI 2023.05.02 16:59 I attest to the accuracy and authenticity of this order/judgment

2023:PHHC:062487 CRM-M-22089 of 2023 -2report is going to be filed. He further submits that report under Section 173 Cr.P.C. shall be filed invoking appropriate provisions of IPC. 4.

In view of statement of learned State Counsel, this Court is sanguine of the fact that investigating agency would file report under Section 173 Cr.P.C. expeditiously and preferably within two months from today after invoking the appropriate provisions of IPC. The jurisdictional police authorities would further consider representation dated 5.4.2023 of the petitioner qua protection of his life and liberty.
