(ORAL) The instant Petition has been filed under Section 439 of the Code of Criminal Procedure seeking Regular Bail on behalf of the Petitioner in case FIR No.461, dated 19th September, 2017, registered under Sections 307, 341, 324, 148, 149 of the Indian Penal Code, 1860 at Police Station Civil Lines, District Amritsar.

The Petitioner, in the present case, has remained in custody for well above 9 months since 11th December, 2019. 3.

After completion of investigation, Challan against him was submitted but Trial in the case has not yet commenced due to on-set of the Covid-19 Pandemic.

It transpires that so far as not even a single Prosecution Witness out of 22 cited in the Challan, has been examined. DEEPAK KUMAR 2020.09.17 01:55 I attest to the accuracy and integrity of this document

Co-accused persons namely Love @ Aarnav Singh (CRM-M No.5124 of 2018) and Rakesh Kumar @ Nona (in CRM-M No.21199 of 2020) have been separately granted Regular Bail by different Benches of this Court, on 9th March, 2018 and 26th August, 2020, respectively.

In the circumstances, without commenting upon the other merits of the case and keeping in view the fact that the trial is likely to take a considerable time to conclude in view of the on-going Covid-19 Pandemic, at this stage, this Court is of the opinion that further detention of the Petitioner for an indefinite period is not justified. As such, he is ordered to be released on bail subject to the satisfaction of the Ld. Trial Court/Duty Magistrate concerned.
