(ORAL) Learned counsel for the petitioner submits that the relief granted to the petitioner vide order dated 14.5.2015 (Annexure P-2) could not be availed by him because of an inadvertent mistake on his part and also due to communication gap between him and his counsel. This was the reason that petitioner had to move an application seeking extension in time which was dismissed by the learned Additional Sessions Judge, vide order dated 6.11.2015 (annexure P-3). He further submits that petitioner is very much ready and willing to surrender before the learned trial court within a period of one week from today and the learned trial court may be directed to consider and decide the bail application of the petitioner in compliance of the directions issued vide order dated 14.5.2015. CRM-M-40590 of 2015 After hearing learned counsel for the petitioner and without expressing any opinion on the merits of the case, lest it should prejudice the rights of either of the parties, present petition is disposed of with a direction to the learned trial court that if the petitioner surrenders within a period of one week from today, it shall consider the bail application of the petitioner keeping in view the totality of facts and circumstances of the case brought to its notice at the instance of the petitioner, by passing an appropriate order, strictly in accordance with law, at an early date.
With the abovesaid observations made and directions issued, present petition stands disposed of.
