The petitioner through instant petition under Articles 226/227 of Constitution of India is seeking setting aside of signal dated 09.04.2024 (Annexure P-6) whereby she has been transferred from Western Command, Chandigarh to BSF, Tekanpur.

The petitioner joined BSF on 24.09.2010. She on account of her past posting in hard area was eligible to get choice posting in the year 2023. She had furnished first, second, third, fourth preference of Jalandhar, Chandigarh, Tekanpur and Jodhpur respectively. The respondent transferred her to Tekanpur, however, on her request temporarily adjusted at Chandigarh. By impugned order, now again, she has been transferred to Tekanpur. 3.

Mr.Nikhil Anand, Advocate submits that a number of vacancies are lying vacant at Jalandhar and the petitioner on account of her past service in hard area is eligible for posting at Jalandhar. CWP-9721-2024 2024:PHHC:059199 and on account of matrimonial discord, she has to look after her children. They are school going and she prays that she may be adjusted for three years at Chandigarh or Jalandhar. She undertakes that she would not claim further stay at Chandigarh or Jalandhar.

Ms. Gurmeet Kaur Gill, Sr. Panel Counsel, accepts notice on behalf of respondents-UOI and submits that if petitioner files fresh representation, the competent authority considering the vacancies available at Jalandhar and entitlement of petitioner to soft postings would pass an appropriate order within a week from the date of her representation. 6.
