***** ARUN MONGA, J. (ORAL) Petitioner herein, inter alia, seeks issuance of a writ in the nature of Mandamus for directing the respondents to give 5 marks of the socio-economic criteria as per advertisement No.15/2019 dated 07.09.2019 (Annexure P-1) for the post of Operation Theatre Assistant (Category No.9).

Haryana Staff Selection Commission advertised 4,322 posts of various departments/boards/corporation including 100 posts of Operation Theatre Assistant. Petitioner applied for the post of Operation Theatre Assistant under BCB category. He appeared in the written examination and thereafter was called for security of documents. He submitted documents including death certificate of his father. However, when the result was declared, petitioner's name was not mentioned in the selection list.

Petitioner's claims that he belongs to BCB category and cut off marks for the said category are 47. Hesecured 43 marks in the written examination but 5 marks under socio-economic criteria have not been awarded to him as per advertisement (Annexure P-1). Qua the aforesaid grievance, petitioner also submitted representations dated 21.04.2022 (Annexure P-9) but the same has not been adverted till date.

On advance service, learned State counsel appears and submits that a decision will be taken by competent authority, either way, on the pending representation dated 21.04.2022 (Annexure P-9) by passing a speaking order.

At this stage, learned counsel for the petitioner also seeks decision on the pending representation, as suggested by learned State counsel.

Given the nature of order being passed, there is no necessity to seek return by any of the respondents as no further proceedings and/or pleadings are required.

Without commenting on the merits of the case, the instant writ petition is disposed of with a direction to the respondents to look into the representation dated 21.04.2022 (Annexure P-9) of the petitioner and pass an administrative order, in accordance with law. 9.
