(ORAL) Present petition has been filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No.17 dated 15.02.2016, registered under Sections 326, 323, 148, 149 and 34 IPC, at Police Station Talwandi Sabo, District Bathinda. It is contended by learned counsel for the petitioner that the petitioner is in custody since 17.07.2017 and all the co-accused of the petitioner have already been released by the trial Court. It is further contended that the report under Section 173 Cr.P.C. has already been submitted before the trial Court and the charges are yet to be framed. The above factual aspect of the matter has not been disputed by the learned State counsel.

Keeping in view the fact that the petitioner is in custody since 17.07.2017 and the final conclusion of trial is to take a long time, it would be just and appropriate if the concession of bail is granted to the petitioner. Moreover, no useful purpose would be served by keeping the petitioner behind the bars any more when all the four co-accused have already been released on bail by the learned trial Court. Therefore, in view of the above-said circumstances, without expressing any opinion on the merits of the case, this petition is accepted. The petitioner is ordered to be released on regular bail on his furnishing adequate bail bonds and surety bonds to the satisfaction of the learned trial Court.
