AMOL RATTAN SINGH, J (ORAL) Learned counsel for the State, on instructions submits that the complainant in the FIR, i.e Baljit Kaur, has testified before the trial Court.
That being so and the petitioner having been in custody for about one year now as per the custody certificate filed by the learned State counsel in court today, with no other criminal case shown to be registered against him and further, with the medical report (Annexure P.3) pointed to by learned counsel for the petitioner stating that initially it had been reported that the victim had fallen from the height, without making any observation with regard to the merits of the aforesaid recording on the MLR, the petition is allowed.
The petitioner shall be admitted to bail upon his furnishing adequate bail bonds and surety bonds to the satisfaction of the learned trial Court.
