Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.216 dated 15.10.2014 under Sections 406 and 420 IPC, registered at Police Station Phase-I, SAS Nagar, Mohali.

Notice of motion was issued. Learned State counsel appeared and contested the petition. On previous dates, learned counsel for the complainant was appearing but today none appeared on behalf of the complainant.

CRM No.M-40735 of 2014 -2Learned counsel for the petitioner contended that petitioner has already deposited `11 lakh, being his share. As per instructions from the petitioner, his counsel stated that petitioner has no objection if this amount is given to the complainant. The perusal of the FIR shows that main allegation against the accused is that the sale deed was registered in favour of complainant Ramanjeet Singh and `6.20 lakhs was paid to the accused before the Sub Registrar regarding plot measuring 8 marla 6 Sarsahi. The allegation against the accused is that he sold more land than the land in his possession.

The petitioner has already joined the investigation. He has also deposited `11 lakhs. The trial of the case will take long time. No useful purpose will be served by sending the petitioner to custody. Keeping in view the facts and circumstances of the case and without discussing the facts of the case in minute details and without expressing any opinion on the merits of the case, I find it a fit case, where the petitioner is entitled to benefit of grant of anticipatory bail. Therefore, the present petition is accepted and the order dated 11.12.2014 granting interim bail to the petitioner, is made absolute.
