(ORAL) Petitioner is seeking the concession of anticipatory bail under Section 438 of the Cr.P.C. in case FIR No.212 dated 14.11.2023 under Sections 379-B (2), 411, 34 of the Indian Penal Code, 1860 registered at Police Station Haibowal, District Ludhiana. 2.

Vide order dated 29.04.2024 passed by a coordinate Bench of this Court, the petitioner had been granted interim anticipatory bail with direction to join investigation and the relevant part of the said order reads as under:- "As per the allegations, the FIR was registered on the basis of secret information to the effect that the petitioner alongwith others are habitual of committing snatching from the people under threat of causing injury with weapons. Though, the co-accused had been apprehended, but not the petitioner. From the apprehended accused, mobile phones, cash and weapons were recovered. CRM-M-21004-2024 -2that petitioner has been falsely implicated; that no recovery was ever effected from him; and that he is ready to join the investigation."

Learned counsel for the petitioner submits that in compliance of order dated 29.04.2024, the petitioner has joined investigation and cooperated with the investigating agency. 4.

Learned State counsel, on instructions from HC Pardeep Singh, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He on further instructions submits that the petitioner is not required for further investigation much less for his custodial interrogation. 5.

In view of the above, the petition is allowed and interim order dated 29.04.2024, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C.
