(ORAL) Prayer in the instant petition filed under Section 438 Cr.P.C. is for grant of anticipatory bail to the petitioners in cross-case registered vide DDR No. 15 dated 04.07.2014, under Sections 325, 324 and 323 read with Section 34 IPC and Section 307 IPC has been added later on vide order dated 26.09.2017, passed by the learned Additional Sessions Judge, Amritsar in case FIR No. 93 dated 21.06.2014 registered under Sections 302, 324, 148 and 149 IPC and Section 25 of the Arms Act at Police Station Majitha, District Amritsar.

Since both the petitioners, namely; Sandeep Singh and Narinder Singh @ Ghulla, have been declared proclaimed offenders and remained absent from the Court in a trial under Section 307 IPC against them, therefore, they are not entitled to any relief from this Court. Considering the overall facts and circumstances of the case, both the petitioners are directed to appear before the trial Court on or before Rishu Kataria 2017.10.31 17:22 I attest to the accuracy and authenticity of this document

CRM-M-40690-2017 (O&M) -210.11.2017 and their application for bail shall be decided by the Court within a week.

In case, the petitioners fail to do so, the instant petition shall be deemed to have been dismissed as withdrawn.

It is, however, also clarified that this order shall not be an embargo in conducting the proceedings against the petitioners under Section 174A IPC by the trial Court.
