*** Learned State counsel submits that as per the verification made by local police from the Passport Authorities, the Passport of the petitioner has expired in the year 2015 and petitioner had stated that he had given his Passport to one Kala Singh, He further submits that Kala Singh has since expired. Learned State counsel states that petitioner has since joined the investigation. This fact is conceded by learned State counsel on instructions from ASI Jasapal Singh. He states that the petitioner is not required for further investigation by the police. Under such circumstances, the interim bail granted to the petitioner on 31.10.2017 is made absolute, subject to his fulfilling conditions under Section 438(2) Cr.P.C.

The petition stands allowed accordingly.

It is made clear that in case the petitioner is found indulging in any criminal activity after being granted bail vide this order, the order shall be liable to be withdrawn.
