(ORAL) Prayer in the instant petition under Section 482 Cr.P.C. has been made for quashing FIR No.217 dated 21.08.2018, registered under Sections 323, 324, 341, 506, 307 IPC and Sections 25/27 of the Arms Act, 1959, Police Station Division No.6, Police District Police Commissionerate Jalandhar, District Jalandhar and all subsequent proceedings arising therefrom, on the basis of compromise (P-2). Pursuant to order dated 27.03.2019 of this Court, the parties appeared before the trial Court on 29.04.2019 along with receipts of `15,000/- to get their statements recorded. Learned Judicial Magistrate Ist Class, Jalandhar, has submitted his report vide letter bearing No.130 dated 09.05.2019 duly forwarded by learned District and Sessions Judge, SONIKA 2019.05.21 12:27 I attest to the accuracy and authenticity of this document Chandigarh
CRM-M-41627 of 2018 --2-- Jalandhar, vide letter bearing No.1389/G/JRK dated 10.05.2019. According to the report, ld. Judicial Magistrate Ist Class, Jalandhar, is satisfied that the parties have arrived at compromise without any undue influence or coercion. No accused has been declared as proclaimed offender.
Considering the report of ld. Judicial Magistrate Ist Class, Jalandhar, dated 09.05.2019 and the fact that the compromise will bring peace and harmony in relations between the parties, aforesaid FIR No.217 dated 21.08.2018 along with all subsequent proceedings arising therefrom, is quashed qua the petitioner only.
Disposed of accordingly.
