(Oral) Prayer is for grant of anticipatory bail to the petitioner in case having FIR No.22 dated 13.2.2013 registered under Sections 307, 34 IPC and Section 25 of Arms Act at Police Station Sadar District Ludhiana. Counsel for the petitioner submitted that the petitioner has been falsely implicated in this case. He further contends that the petitioner was not named in the FIR and later on named as an accused in the supplementary statement of complainant-Kulwant Singh. The counsel for the petitioner further contends that Harpreet Singh and Kadhain, who were named as GAURAV SOROT 2022.08.18 13:02 I attest to the accuracy and authenticity of this order/judgment
( 2 ) CRM-M-22697-2022 accused in the FIR were later on discharged by the police. The counsel for the petitioner further submits that the petitioner has joined investigation with the police in the light of previous order dated 24.5.2022 passed by the Coordinate Bench of this Court. State counsel on instructions ASI Iqbal Singh has not disputed the fact that the petitioner has joined investigation with the police and further submits that recovery has already been effected in this case and that now the petitioner is not required by police for further investigation or for custodial interrogation.
In view of the above and without commenting on the merits of the case, present petition is allowed and order dated 24.5.2022 is hereby made absolute. The petitioner should abide by the conditions envisaged under Section 438(2) Cr.P.C.
