Matter was referred to mediation and conciliation centre. Admittedly, petitioner and complainant have entered into an agreement which has been reduced into writing.

At the outset it has been pointed out that out of `37.00 lacs amount to be paid to the complainant, `20.00 lacs have already been remitted. Today counsel for the petitioner seeks to place on record an affidavit of Dr. Bhupinder Kumar Gupta wherein he has stated that he would abide by the terms of the affidavit.

Petition is, thus, disposed of. Petitioner would, however, join investigation as and when summoned by the investigating officer. In the even of his arrest, he shall be admitted to bail subject to provisions of section 438(2) Cr.P.C.
