BEDI, J (ORAL) This order will dispose of the above noted two petition i.e., CRM-M-40793-2014 filed by Survinder Kaur mother-inlaw of deceased and CRM-M-42499-2014 filed by Gurmeet Singh Grover father-in-law and Parmeet Kaur alias Sonia the wife, for the grant of pre-arrest bail in a case registered at the instance of Harsh Kumar alleging that the deceased Dinesh was tortured by his wife and parents-in-law as a result of which he committed suicide by RAJ KUMAR ARORA 2015.02.06 16:12 I attest to the accuracy and integrity of this document

CRM-M-40793-2014 (O&M) consuming tablets of sulphas. The incident and the FIR pertain to the year 2009 but the attempt is being made to arrest the petitioner after five years.

State counsel has tried to explain the period of five years by stating that the report of the handwriting expert has been received regarding the suicide note in the year 2014. A perusal of police file indicates that the report was prepared on 24.2.2010.

Pursuant to the interim orders the petitioners have already joined investigation. After a gap of five years, there does not appear to be any requirement for the custodial interrogation of the petitioners.

Both the petitions are allowed. It is ordered that in case of arrest of the petitioners, they will be released on bail to the satisfaction of the arresting officer subject to the conditions that they will join investigation as and when required and will not tamper with the evidence or hamper the investigation in any manner.
