The present petition has been filed under Section 482 Cr.P.C. for issuance of necessary directions to the respondents No.2 and 3 to conduct fair inquiry in FIR No.18 dated 19.03.2016, registered under Sections 420, 467, 468, 471 and 381 of IPC, registered at Police Station Kot Dharmu, District Mansa.

Upon advance notice, learned State counsel on instructions from ASI Om Prakash submits that on account of pendency of civil dispute the investigation in the aforementioned FIR could not be concluded, however, learned counsel for the petitioner referred to the judgment and decree dated 02.12.2019 so as to point out that the civil litigation regarding possession and declaration has been adjudicated upon by the learned trial court though the appeal is pending.

Having heard learned counsel for the petitioner and gone through the paper-book there does not appear to be any justification in the inordinate delay on the part of the investigating agency in concluding the investigation.

Consequently, this petition is disposed of with the direction to the State to file its final report before the trial Court within a period of 4 weeks from today. The same shall however be subject to payment of cost of Rs.10,000/- to be deposited with High Court State Legal Services Authority, Chandigarh within 15 days from today.
