**** ANITA CHAUDHRY, J (ORAL) Through the instant petition, the petitioner is seeking anticipatory bail in case FIR No. 17 dated 22.1.2018, registered under Sections 498-A, 406 IPC, Police Station Dinanagar, District Gurdaspur. Counsel for the petitioner states that pursuant to the order dated 21.9.2018, passed by this Court, the petitioner has joined the investigation. Counsel further submits that all the ornaments which were in his possession have been handed over. Copy of the list has been handed over. Counsel also submits that the household articles have also been returned. He further submits that petitioner is not an NRI.

State counsel states that the petitioner has joined the investigation. State counsel informs that one chain, one set, one pair of tops and one gold kara remain.

The articles are disputed. The amount which has been deposited by the petitioner would be given to the complainant. The amount can be released to the complainant.

The petitioner is in India. He will not leave the country without the prior permission of the Court below. He will also place on record copy of his passport before the Court below.

Looking to the circumstances, but without commenting on the merits of the case, the petition is allowed and order dated 21.9.2018 granting interim bail to the petitioner is made absolute subject to the conditions laid down in Section 438 Sub Section 2 Clauses (i)(ii) and (iii) of the Code of Criminal Procedure.
