**** ANITA CHAUDHRY, J (ORAL) The petitioner is seeking regular bail in FIR No. 331 dated 25.12.2017 registered at Police Station Shahkot, District Jalandhar under Sections 376, 341, 323, 148, 149 IPC.

Status report has been filed by the State according to which challan has been presented but charge has not been framed yet and the case is fixed today.

Counsel for the petitioner contends that allegations of rape are not against the petitioner and no video was recovered and the allegations are that the petitioner had made a video. The counsel further submits that two accused have already been allowed regular bail. State counsel informs that Surjit Singh is the main accused and he had been arrested and two accused have been declared proclaimed GURPREET SINGH 2018.10.30 15:40 I attest to the accuracy and authenticity of this document chandigarh

Petitioner is in custody since 5.5.2018. The FSL report is negative. There are no allegations of rape against the petitioner. No video was recovered. The trial would take time.

Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
