Present:
Mr. Shreenath A. Khemka, Advocate for the petitioner. Mr. Satya Pal Jain, Addl. Solicitor General of India with Namit Kumar, Sr. Panel Counsel for UOI.
Mr. Hitesh Pandit, Addl. A.G. Haryana.
RAJAN GUPTA J. (ORAL) Case has been taken up on Video Conferencing in view of COVID-19 Pandemic.
After arguing at some length, learned counsel for the petitioner submits that he is merely seeking consideration for empanelment which aspect was not considered by the Tribunal. According to him, Tribunal proceeded on a wrong premise that petitioner was seeking a mandamus to empanel him. He submits that he shall be satisfied if his representation is decided by the UOI by passing a speaking order.
We, thus, dispose off this petition with a direction that in case petitioner files a fresh representation within two weeks from today, the concerned authority of Government of India shall pass a speaking order thereon at the earliest, in any case not later than one month. In view of above, no further adjudication of the matter is necessary. (RAJAN GUPTA) JUDGE (KARAMJIT SINGH) JUDGE August 24, 2021 Ajay Whether speaking/reasoned:
