*** PANKAJ JAIN, J. (ORAL) Prayer in this petition filed under Section 438 Cr.P.C. is for grant of pre-arrest bail in case FIR No.06 dated 13.01.2024, registered under Sections 21/22/29/61/85 of the NDPS Act, at Police Station Garhshankar District Hoshiarpur.

As per the case of the prosecution accused Sourav was apprehended and found to be in possession of 21 injections of Burenorphine. After his disclosure, the source happens to be his mother-inlaw i.e. the petitioner herein. 3.

Reply has been filed. As per the same, the petitioner does not have clean antecedents. He was prior convicted in FIR No.56 dated 11.04.2019, registered at Police Station Garhshankar, District Hoshiarpur, qua offence under Section 22 of the NDPS Act, 1985 and there is another FIR No. 209 of 2022, pending against the petitioner, qua offence under SATYAWAN 2024.05.16 22:48

Section 15/21/22/61/85 of NDPS Act, registered at Police Station Garhshankar, District Hoshiarpur. Though, the petitioner is on bail in the said case, however, keeping in view the prior antecedents of the petitioner, he does not deserve concession of anticipatory bail. Consequently, the instant petition is dismissed.
