M.M.S. BEDI, J (ORAL) The petitioner seeks concession of regular bail in a case registered at the instance of Amandeep Kaur alleging that her daughter aged 31⁄2 months old was thrown in a gutter by Kamalpreet Kaur daughter of the petitioner.
So far as the petitioner is concerned, she allegedly bolted the complainant in the kitchen.
Counsel for the petitioner submits that the petitioner has been in custody w.e.f. 11.5.2014 and that the trial has unnecessarily been delayed.
During the course of arguments, it transpires that on account of controversy regarding the mental state of co-accused of the petitioner Kamalpreet Kaur, the trial Court had been seeking the reports from the psychiatrics.
CRM-M-40910-2014 (O&M) On asking of the Court about the present status of the trial, it has been informed that now the trial is fixed for recording of the statement of two witnesses on 17.8.2015. The complainant has not yet been examined. Taking into consideration the fact that the petitioner and the complainant are related to each other being mother-in-law and daughter-in-law with an objective to avoid any chance of tampering of evidence, this petition is disposed of with a direction that trial Court shall make earnest endeavour to record the statement of the complainant within a period of 3 months from the next date of hearing and would release the petitioner on bail after the statement of complainant Amandeep Kaur is recorded within the period aforementioned.
