Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.220 dated 15.12.2016 under Sections 364, 302, 201, 148 and 149 IPC, registered at Police Station City I Abohar, District Fazilka.

Notice of motion was issued. Learned State counsel as well as learned counsel for the complainant appeared and contested the petition. I have heard learned counsel for the parties as well as learned State counsel and have gone through the record. CRM No.M-4088 of 2017 -2the FIR. Though the murder took place in the year 2010 and the FIR was registered after about six years in December 2016, but in 2010, a missing report was already there and dead body was found from Gang Canal after about eight days with head injury as per the PMR. Now, learned State counsel states that there is extra judicial confession of the present petitioner. Motive for causing the murder is also there. The clothes of deceased have been recovered from the co-accused and he argued that there is sufficient evidence on record showing the involvement of the present petitioner in the commission of offence Keeping in view the nature and gravity of the offence and the fact that petitioner is required for custodial interrogation, I do not find it a fit case where petitioner is entitled to benefit of anticipatory bail. Therefore, finding no merit in the present petition, the same is dismissed.
