Prayer in the present petition filed under Section 483 BNSS is for grant of regular bail to the petitioner in case FIR No.324 dated 19.10.2025, registered under Sections 7 of PC Act and 42, 52 of Prison Act at Police Station Islamabad, District Amritsar.

Learned counsel contends that the petitioners have been in custody for about 7 months. They allege false implication. No recovery has been effected from them. They are at parity with co-accused Parlad Singh alias Prehlad Singh and Prabhjit Singh @ Prabh, who have since been granted regular bail vide orders dated 20.04.2026 and 22.04.2026, after being in custody for more than 5 months. Challan was presented on 18.12.2025, however, charges have not been framed and in all there are 18 prosecution witnesses. The petitioners are not involved in any other case. 3.

Learned State counsel opposes the bail on the ground that the petitioners were working as PESCO employee inside the jail and used to provide banned items to the inmates. However, he is unable to controvert the MOHIT 2026.05.21 14:56 I attest to the accuracy and integrity of this document

Heard.

Considering the facts and circumstances of the case, in particular that the petitioners are in custody for the last 6 months and 26 days; not involved in any other case; co-accused are on bail; challan stands presented on 18.12.2025, however, charges are yet to be framed on and there are a total of 18 prosecution witnesses, the trial is likely to take a considerable time, further incarceration of the petitioners would be violative of his right enshrined under Article 21 of the Constitution of India, the present petition is allowed. 7.

The petitioners are ordered to be released on regular bail on their furnishing requisite bail bond/surety bond to the satisfaction of the trial Court/Duty Magistrate, concerned.

It is made abundantly clear that in case there is any breach of the conditions, the State shall be at liberty to seek cancellation of bail as granted to the petitioners by this order.

In view of the above, it is clarified that the observations made herein above are limited for the purpose of present proceedings and would not be construed as any opinion on the merits of the case and the trial would proceed independently of the aforesaid observations.
