R.P. Nagrath, J. (Oral) Petitioner seeks bail under Section 439 Cr.P.C. in FIR No. 07 dated 12.01.2014 for offence under Sections 15 of Narcotic Drugs and Psychotropic Substances Act, 1985, registered at Police Station Sadar, Sunam, District Sangrur.

Earlier application for grant of bail was dismissed as withdrawn at that stage on 08.09.2014 in CRM-M-28275 of 2014. It is submitted that there are nine FIRs registered against the petitioner and in five of those FIRs, the petitioner was acquitted. In one FIR, the petitioner was convicted on 11.07.1997 and in other case on 02.11.2012, in which he was awarded sentence for a period of one month. That FIR No. is 207 dated 11.10.2009.

As per prosecution story, recovery of two bags containing 55 kgs. of poppy-husk was made. The petitioner was not arrested at the spot.

CRM-M-4085 of 2015 -2Learned State counsel submits that charges against the petitioner have already been framed.

The petitioner is in custody since 15.05.2014 and it will take long time in conclusion of the trial.

In view of the above and without commenting on the merits of the case, the instant petition is allowed and the petitioner be admitted to bail on furnishing bail bonds to the satisfaction of the trial Court.

Allowed in the above terms.
