ARVIND SINGH SANGWAN, J. (Oral) The petitioners pray for grant of anticipatory bail in complaint No.01 dated 06.01.2014 in which vide order dated 11.07.2017 the petitioner has been summoned under Section 302 read with Section 34 IPC to face trial.
Counsel for the petitioner submits that in pursuance to the order dated 01.11.2017, the petitioner has already appeared before the trial Court and has been granted interim bail. It is further submitted that the case has been committed to the Court of Sessions. Counsel for the State has not disputed the factual position. In view of the above, the petition is allowed and the interim bail granted to the petitioner vide order dated 01.11.2017 is made absolute subject to the conditions envisaged under Section 438(2) Cr.P.C.
