The petitioner has filed this second petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.30 dated 5.4.2013 registered for the offences under Sections 307, 324, 323, 34 and 302 IPC at Police Station Bilga, District Jalandhar.

Notice of motion to Advocate General, Punjab. On the asking of the Court, Ms. Simsi Dhir Malhotra, learned Deputy Advocate General, Punjab has put in appearance on behalf of the respondent-State and accepted notice and contested this petition. Police record is also available.

From the record, I find that the FIR was registered on the statement of Harjinder Singh alias Pannu. As per the FIR, Dalbir Singhpresent petitioner was armed with a spade and he gave fatal injury to the father of the complainant on his head with intention to kill him. The father of the complainant died due to this injury.

Keeping in view the nature and gravity of the offences and the fact that the present petitioner is the main accused, who caused the fatal injury to the deceased, I do not find any reason or ground to grant bail to him in this case.

Therefore, finding no merit in this petition, the same is dismissed.

However, as the petitioner is in custody since 12.4.2013, the trial Court is directed to expedite the trial by giving short adjournments and if requires even by giving day to day adjournments. The Investigating Officer of this case is to produce the witnesses on the next date and will make every effort to produce all the remaining witnesses on the next two/three dates before the trial Court.
