In a case of clash of two unlawful assemblies, the petitioner had been granted the concession of bail. On addition of offence u/s 308/325 IPC he has again been arrested on 8.10.2016 on the allegation of having caused injuries on the head and wrist of complainant and Mohan Singh, respectively. He has also been attributed a gandasi blow from the reverse side on the head of Sarabjit Singh. Statement of Sarabjit Singh was recorded after about two months of the occurrence. Without expression of any opinion on merits of the case it is sufficient to observe that the petitioner has been in custody since 8.10.2016; the individual role of the petitioner as a member of an unlawful assembly would be debatable during trial.

The petition is allowed. The petitioner is ordered to be released on bail on his furnishing bail bonds/ surety bonds to the satisfaction of the CJM, Sangrur.
