JITENDRA CHAUHAN, J. (Oral) The petitioner seeks anticipatory bail under Section 438 of the Code of Criminal Procedure, in FIR No.150 dated 25.10.2008, under Sections 279 and 304-A of the Indian Penal Code, registered at P.S. Sector 18, Gurgaon.
Contends that the petitioner was released on bail and he had been appearing regularly before the trial Court. The matter was compromised between the parties on 21.08.2013, therefore, the petitioner remained under a bona fide impression that he need not appear before the Court. Thereafter, he was declared as a proclaimed person on 25.03.2014. Heard.
Keeping in view the fact that the petitioner has been declared a proclaimed person, no case for grant of bail is made out. However, considering the fact that the wife of the deceased had entered into a compromise with the petitioner, it is ordered that in case, the petitioner surrenders and files a bail application, the same be decided Sanjay 2016.11.23 18:36 I attest to the accuracy and integrity of this document
