Through the present petition filed under Section 438 Cr.P.C., the petitioner seeks the grant of anticipatory bail in FIR No.417 dated 22.09.2016, registered under Sections 406 and 420 IPC, at Police Station Gannaur, District Sonepat.
Vide order dated 12.12.2016 passed by this Court, the petitioner was granted concession of ad-interim anticipatory bail, subject to his joining investigation, to the satisfaction of the arresting officer. Learned counsel for the parties are ad idem that Munaver, who has been attributed an identical role as the petitioner, has been granted concession of anticipatory bail by an order of this Court dated 10.11.2016 Monika 2017.03.08 17:19 I attest to the accuracy and integrity of this document passed in Crl. Learned counsel for the petitioner claims parity and on that ground, the interim order dated 12.12.2016 is made absolute, subject to the conditions prescribed under Section 438(2) Cr.P.C. Nothing observed herein above shall be considered to be an expression of opinion by this court on the merits of the case. If the petitioner is found indulging in any other criminal act or misusing the concession of bail granted by this Court, it would be open to the State to seek cancellation of bail granted through this order by filing an appropriate application before the competent Court/this Court.
