Petitioner has filed this third petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.258 dated 19.07.2015 under Sections 148, 149, 323, 325, 307, 395, 397, 452, 506 IPC and Section 25 of the Arms Act, registered at Police Station Tauru, District Mewat. Notice of motion was issued. Learned State counsel as well as learned counsel for the complainant appeared and contested the petition. I have heard learned counsel for the parties as well as learned State counsel and have gone through the record. From the record, I find that the present petitioner is named in Vineet Gulati 2017.03.23 16:39 I attest to the accuracy and authenticity of this document Chandigarh the FIR. He was stated to be armed with country made rifle, from which he
CRM No.M-41926 of 2016 -2fired shot. Learned counsel for the petitioner contended that the fire shot did not hit anybody, whereas learned State counsel as well as learned counsel for the complainant stated that fire shot hit on the thumb of one of the injured. In the present case, there are 26 injured persons. Keeping in view the facts and circumstances of the present case and in view of the fact that petitioner was armed with deadly weapon and has taken active participation in the commission of the offence by firing shot from the country made rifle, I do not find it a fit case where the petitioner is entitled to benefit of bail.
Therefore, finding no merit in the present petition, the same is dismissed.
