***** ARCHANA PURI, J. (Oral) CM-7089-CII-2026 Keeping in view the averments made in the application, same is allowed.

Main case The petitioner has filed the present petition, for initiation of contempt proceedings, against the respondents, on account of wilful noncompliance of the order dated 01.09.2025, passed by the Coordinate Bench, in CWP-25742-2025.

However, perusal of the requisite order reads as hereingiven:- "XXXX XXXX XXXX XXXX

(1) Since, as on date, there is no decision taken by any authority with regard to transfer of the land in question, learned counsel for the petitioner withdraws this petition being pre-mature. HIMANSHU VATS 2026.04.07 09:45 I attest to the accuracy and authenticity of this document

(2) Disposed of."

Even though, now it is submitted by the counsel for the petitioner that it was on the disclosure made by learned State Counsel about there to be no decision taken by any authority, with regard to the transfer of the land in question, the writ petition was withdrawn by the petitioner, but however, there is no mention made to this effect, in the order dated 01.09.2025. In the light of the same, what can be gathered from the aforesaid order, is that the petitioner had withdrawn the petition, being premature.

On query by this Court, it is submitted that the petitioner has yet not filed any writ petition, after passing of the order dated 09.02.2026 by the Commissioner & Secretary to Government of Haryana, Development and Panchayats Department, copy whereof is Annexure P-8. In the light of the aforesaid, the contempt process is not attracted, in defiance of the order dated 01.09.2025, passed by the Coordinate Bench.

Hence, the present contempt petition is hereby dismissed, being not maintainable.
