Versus
Raj Kumar & Ramgobind Memorial Educational Society ....Respondent CORAM: HON'BLE MR. JUSTICE ARVIND SINGH SANGWAN
Present:
Mr. Surinder Gaur, Advocate for the petitioner. Mr. Anshumaan Dalal, Advocate for the respondent. ARVIND SINGH SANGWAN J. (Oral) This is a petition under Section 482 Cr.P.C. seeking quashing of criminal complaint No.241 dated 18.02.2016 (Annexure P1) pending before the trial Court under Section 138 of the Negotiable Instruments Act read with Section 420 IPC.
Learned counsel for the petitioner, at the very outset, submits that he has already moved an application for compounding all the offences along with demand draft.
In view of the above, the present petition is dismissed having been rendered infructuous. However, it will be open for the petitioner to challenge an order adverse to her rights passed by the trial Court on such application.
At this stage, counsel for the petitioner submits that the petitioner is a lady, residing in New Delhi and it is very difficult for her to appear before the trial Court on each and every date of hearing. Liberty is granted to the petitioner to approach the trial Court under Section 403 Cr.P.C. The trial Court may consider the case of the petitioner to allow her to appear through her counsel. 24.07.2017 (ARVIND SINGH SANGWAN) yakub JUDGE Whether speaking/reasoned:
