 Section 438 of the Code of Criminal Procedure, 1973, for grant of anticipatory bail in case FIR No.45 dated 06.06.2017, registered at Police Station Singh Bhagwantpura, District Rupnagar, under Sections 323, 341, 325, 506, 148 and 149 of the Indian Penal Code, Section 326 of the Indian Penal Code added alter on and Section 27 of the Arms Act. Notice of motion was issued in this case.

Learned State counsel put in appearance on behalf of the respondent-State and contested this petition. I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that the FIR has been got registered by complainant-Sandeep Singh. As per the complainant, the present petitioner is stated to be armed with Kirpan and gave injury on the left hand of the Rajesh Kumar 2017.12.05 17:02 I attest to the accuracy and authenticity of this document Chandigarh

  

 && complainant/injured. However, the MLR shows that the injury has been described as simple in nature with blunt weapon. Further, it is a case of version and cross-version and it is yet to be decided by the learned trial Court as to who is the aggressor party.

Therefore, keeping in view the facts and circumstances of the present case; without discussing the facts of the case in minute details and without expressing any opinion on the merits of the case, I find merit in this petition and the same is allowed. It is ordered that
