bearing FIR No.221 dated 23.08.2019, registered at Police Station Sadar Ratia, District Fatehabad, under Sections 22-C and 27-A NDPS Act, 1985. Learned counsel for the petitioner contends that the petitioner is not named in the FIR; that he has been indicted on the disclosure statement suffered by co-accused, Rupa Singh and that no other case under the NDPS Act is pending against the petitioner, who is physically handicapped from his legs to the extent of 100%.
On the other hand, learned State counsel while opposing the prayer made in the present petition, submits that there are as many as two other cases i.e. one under the Excise Act and another under Section 174-A PARVEEN KUMAR 2020.08.11 04:26 I attest to the accuracy and integrity of this document

I have heard the learned counsel for the parties. The factual matrix, as stated above by the learned counsel for the petitioner, could not be refuted by the learned State counsel on the basis of instructions received by him from the Investigating Officer. The petitioner has been indicted in the present case on the basis of disclosure statement of co-accused. Charges have been framed. The petitioner has been in custody since 24.08.2019. Trial of the case would take time to conclude. Therefore, no useful purpose would be served by keeping the petitioner behind the bars.
