***** RAJ MOHAN SINGH, J .(Oral) Petitioner seeks grant of regular bail under Section 439 Cr.P.C in case bearing FIR No.77 dated 24.02.2018, registered under Sections 15, 18 and 29 of NDPS Act and under Section 180 and 201 of IPC at Police Station Sadar, Thanesar, District Kurukshetra.

As per allegations in the FIR, 15 KG of opium besides 28.5 Kgs. of poppy husk was allegedly recovered from the petitioner from the cabin of the truck in which petitioner was a cleaner.

CRM-M-20723-2019 (O&M) -2Surender Singh states that out of 22 prosecution witness, 16 witnesses have already been examined. The next date is 22.01.2020 and there is every likelihood of the trial being concluded within short period. Learned State counsel further states that two more prosecution witnesses have been bound down for 22.01.2020 and thereafter, prosecution shall conclude the prosecution witnesses, if any, within a reasonable period. Looking to the recovery and other attending circumstances of the case, I deem it appropriate to dispose of this petition at this stage by directing proseuction to conclude the trial within 2 months from the next date of hearing. In the event of not concluding the trial within prescribed period, the petitioner shall have a right to press for his regular bail before the Trial Court. In the event of filing such petition, the same shall be decided in accordance with law.
