Petitioner has filed this second petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.154 dated 29.07.2016 under Sections 302, 120-B IPC and Section 25 of the Arms Act, registered at Police Station Maur, District Bathinda.

Notice of motion was issued. Learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that present petitioner is the main accused. As per the allegations in the FIR, he fired two shots from .315 bore rifle, out of which, one fire shot hit the son of the complainant, who VINEET GULATI 2018.09.18 14:57 I attest to the accuracy and authenticity of this document Chandigarh died.

CRM No.M-41092 of 2017 -2Keeping in view the facts and circumstances of the present case, in view of the serious allegations against the petitioner, nature and gravity of the offence and without discussing the facts in minute detail and without expressing any opinion on the merits of the case, I do not find it a fit case where petitioner is entitled to benefit of regular bail. Therefore, finding no merit in the present petition, the same is dismissed.
