Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner(s) in case FIR No. 185 dated 11.08.2015, registered under Section(s) 22/61/85 of the Narcotic Drugs & Psychotropic Substances Act, 1985 at Police Station Machhiwara, Police District Khanna. Learned counsel for the petitioner contended that petitioner was admitted to bail in the case and was appearing regularly before the learned trial Judge and his bail was cancelled on 10.04.2019 on the ground that petitioner failed to appear on that day. Learned counsel further contended that petitioner had met with an accident on that date and that is why he could not appear before the learned trial Court, otherwise there was no reason for him not to appear and now he is ready to surrender before the learned trial Judge and face trial.

Criminal Misc. No. M-20325 of 2019 General, Punjab accepts notice on behalf of respondent. A copy of paperbook be provided to him during the course of the day. In view of above, present petition stands disposed of with the directions that in case petitioner surrenders before the learned trial Court within a period of one week from today and moves an application for grant of bail, he shall be admitted to bail on his furnishing fresh bail bonds and surety bonds to the satisfaction of the learned trial Judge. However, the learned trial Judge shall be at liberty to complete the proceedings under Section 446 Cr.P.C.
