SUMEET GOEL, J.(Oral) Present petition has been filed under Section 482 Cr.P.C for quashing of impugned order dated 22.12.2023 passed in case bearing CIS No.COMA/10359/2018 dated 30.07.2018 titled "M/s Daman Textiles Vs. M/s Jindal Textiles and another", whereby the petitioner has been declared as a proclaimed person.

On 27.08.2024, the following order was passed by this Court:- "The prayer in the present petition under Section 482 Cr.PC is for quashing of the impugned order dated 22.12.2023 (Annexure P-5) passed in case bearing CIS No.COMA/ 10359/2018 dated 30.07.2018 titled as 'M/s Daman Textiles Vs. M/s Jindal Textiles and anr.' vide which the petitioner has been declared a proclaimed person. The learned counsel for the petitioner contends that on account of noting down of a wrong date, the petitioner was YAG DUTT 2026.03.12 17:25 I attest to the accuracy and authenticity of this document

CRM-M-21379-2024 (O&M) -2unable to appear on 08.09.2023 on which date, the impugned order came to be passed. He states that the petitioner is ready and willing to join the proceedings once again. Adjourned to 26.09.2024.

In the meantime, subject to deposit of Rs.50,000/- as costs with Sadhna Society for the Mentally Handicapped, Near Housing Board Chowk, Raen Basera Building Manimajra, Sector 13, Chandigarh, the operation of the order dated 22.12.2023 (Annexure P-7) shall remain stayed. Further, the petitioner is directed to surrender before the Trial Court within a period of one week from today and shall be admitted to interim bail to the satisfaction of the Trial Court.

A copy of the receipt depositing a sum of Rs.50,000/- with the aforesaid Society as well as a copy of the order granting interim bail to the petitioner be produced in the Court on the next date of hearing."

Learned counsel for the petitioner has submitted that the petitioner has caused appearance before the concerned Court, in view of the aforesaid order dated 27.08.2024 and is continuing to appear before the said Court.

In the considered opinion of this Court and in the interest of justice, the present petition is allowed and the impugned order dated 22.12.2023 is quashed.
