(ORAL) Prayer in the instant petition filed under Section 438 Cr.P.C. is for grant of anticipatory bail to the petitioner in Case No. 63 dated 19.04.2016, pending in the Court of learned Additional Sessions Judgecum-Judge, Special Court, Tarn Taran, arising out of FIR No. 187 dated 27.11.2014 registered under Section 22 of the NDPS Act at Police Station Goindwal Sahib, District Tarn Taran.
The petitioner facing trial in the aforesaid FIR, was earlier on regular bail. However, due to noting down of wrong date, the petitioner absented on 06.10.2017 and his bail bonds and surety bonds were forfeited to the State.
Learned counsel for the petitioner contends that the trial is fixed for tomorrow i.e. 03.11.2017, therefore, the petitioner may be directed to appear before the trial Court on tomorrow itself. Considering the overall facts and circumstances of the case, the petitioner is directed to appear before the trial Court on 03.11.2017, the date Rishu Kataria 2017.11.02 13:33 I attest to the accuracy and authenticity of this document

In case, the petitioner fails to do so, the instant petition shall be deemed to have been dismissed as withdrawn.
It is, however, also clarified that this order shall not be an embargo in conducting the proceedings against the petitioner under Section 174A IPC by the trial Court.
The instant petition stands disposed of, accordingly. A copy of this order be given dasti under the signatures of Reader of this Bench, to learned counsel for the petitioner.
