IN THE HIGH COURT OF PUNJAB AND HARYANA

AT CHANDIGARH CRR-1152-2022 Date of Decision: May 30, 2022 Ankush Kumar .....Petitioner

Versus

State of Punjab ......Respondent CORAM: HON'BLE MR.JUSTICE RAJESH BHARDWAJ

Present:

Mr.J.S.Ghumman, Advocate for the petitioner.

........

RAJESH BHARDWAJ, J.(ORAL) The petitioner has filed the present revision petition impugning the order dated 24.03.2022 passed by learned Additional Sessions Judgecum-Fast Track Special Court (POCSO), Jalandhar, vide which it has rejected the prayer made by the petitioner seeking default bail. It is contended that the petitioner was arrested on 05.12.2021 and the challan was presented on 12.01.2022. The precise argument raised by counsel for the petitioner is that at the time of presenting the challan, it was incomplete. He submits that the trial Court, in fact, proceeded after the filing of supplementary challan.

Heard.

The arguments raised by counsel for the petitioner have been duly appreciated by the trial Court. The Court was competent enough to take cognizance of the case. Merely because the supplementary challan was filed later on would grant no right to the petitioner to seek indefeasible right under Section 167 Cr.P.C.

The Court finds no infirmity in the conclusion arrived at by the trial Court. Hence, the petition being devoid of any merit is hereby dismissed.
