RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner Tejwant Singh @ Fauji @ Pandit in a case arising from FIR No.101 dated 28.06.2017 under Section 15 of the Narcotic Drugs and Psychotropic Substances Act registered at Police Station Dehlon, District Ludhiana.

It is not clear from the FIR as to whether the poppy husk was weighed with or without bags containing it. The recovery of 53 kgs of poppy husk, which is marginally higher than the commercial quantity, may be on account of weight of the bags.

Considering over-all facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner is ordered to be released on bail, on his furnishing bail bonds and surety bonds, to the satisfaction of Trial Court/Duty Magistrate concerned.
